Online Service Provider Must Say "NO" to Unlawful Contents

Weibo, the Chinese Twitter-like service, was implemented an administrative penalty by the government authority on March 28, 2017 for spreading pornography since it started providing audio-visual programs in February 2015 without obtaining license and it didn¡¯t fulfill its obligation on examination and supervision as an online service provider.

 

On April 16, 2017, a man named Steve Stephens in Cleveland, Ohio posted a video on Facebook Live of himself announcing his intent to commit murder. Two minutes later he posted another video of himself shooting and killing an elderly man. Two hours after the first video was posted online, Facebook deleted the video and blocked Steve¡¯s Facebook account. At the Facebook¡¯s annual developers¡¯ conference, the chief executive Mark Zuckerberg said: ¡°We have a lot of work to do and we will keep doing all we can to prevent tragedies like this.¡±

 

Internet is a place of much more freedom than the reality world and people like to share their lives online. At the same time, photos and videos are more popular than text. As the development of science and technology, Live APPs and websites with Live function are popping up across the world. However, the broadcasting of unlawful contents such as pornography and violence reflects not only the absence of netizens on morality and legal mind but also the lack of online service providers¡¯ supervision.

 

According to Chinese laws and regulations, in order to conduct businesses of webcast, the entity shall obtain a license of qualification from relevant government authority. In addition, while the entity is conducting the webcast business, it shall make sure that the contents uploaded on its website are lawful and haven¡¯t violated any public or private interests or rights. Should there be any violation of public or private interest; the entity shall be held legally responsible for that.
